Terms of Service
These Terms of Service ("Terms") govern your use of the Porthole mobile application ("the App"), developed by Scott Mobile Works LLC ("we," "us," or "our"), operating under the Benchmark Studio brand.
By downloading or using Porthole, you agree to these Terms. If you do not agree, do not use the App.
1. Use of the App
Porthole is a mobile dashboard application for app developers. You may use the App only for lawful purposes and in accordance with these Terms.
You agree not to:
- Use the App in any way that violates applicable law or regulation
- Attempt to gain unauthorized access to any part of the App or its infrastructure
- Reverse engineer, decompile, or disassemble the App
- Use the App to store or transmit malicious code
- Interfere with the operation of the App or its servers
2. Accounts
To use Porthole, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You must provide accurate information when creating your account. You may not create an account on behalf of someone else without their permission.
3. Third-party integrations
Porthole allows you to connect third-party services by providing API keys and credentials. You are responsible for ensuring you have the right to use those credentials and that doing so complies with the terms of those third-party services.
We are not responsible for the availability, accuracy, or content of data retrieved from third-party services.
4. Subscriptions and payments
Porthole is free to download. Optional paid plans are available via in-app purchase through the Apple App Store or Google Play Store.
Subscriptions automatically renew unless cancelled before the renewal date. All purchases are processed by Apple or Google and are subject to their respective terms and refund policies. We do not process payments directly.
5. Intellectual property
The App, including its design, code, and content, is owned by Scott Mobile Works LLC and is protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the App.
6. Disclaimer of warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
The data displayed in Porthole is retrieved from third-party services. We do not guarantee the accuracy, completeness, or timeliness of that data.
7. Limitation of liability
To the fullest extent permitted by law, Scott Mobile Works LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the twelve months preceding the claim.
8. Termination
We may suspend or terminate your access to the App at any time if you violate these Terms. You may terminate your account at any time by requesting deletion through the App or by contacting us at support@scottmobileworks.com.
9. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Texas.
10. Changes to these terms
We may update these Terms from time to time. When we do, we will update the "last updated" date at the top of this page. Continued use of the App after changes constitutes acceptance of the updated Terms.
